Hoger Beroep

Het komt regelmatig voor dat er een vonnis wordt gewezen waarmee een of beide partijen het niet mee eens zijn. Bent u niet eens met het vonnis van de rechtbank? Dan bestaat er een mogelijkheid om in hoger beroep bij het gerechtshof tegen dit vonnis op te komen. Deze mogelijkheid geldt echter niet voor civiele zaken met een financieel belang van minder dan 1.750, – euro. Bent u wel eens met het vonnis van de rechtbank? Dan kunt u alsnog betrokken raken in de procedure bij het gerechtshof. Immers, ook uw tegenpartij kan uiteraard besluiten om in hoger beroep te gaan.

De mogelijkheid van hoger beroep is geregeld in titel 7 van het Wetboek van Burgerlijke Rechtsvordering. Aan deze mogelijkheid light het principe van behandeling van de zaak in twee instanties: in de eerste aanleg doorgaans bij de rechtbank en in hoger beroep bij het gerechtshof. Verondersteld wordt dat een volledige behandeling in twee instanties de kwaliteit van de rechtspraak, alsook het vertrouwen van de burgers in de rechtspleging ten goede komt. Het hoger beroep heeft namelijk een tweetal belangrijke functies:

• Controlefunctie. In hoger beroep vraagt u aan het gerechtshof om opnieuw en volledig naar uw zaak te kijken. Het gerechtshof controleert derhalve of de rechter in eerste aanleg de feiten juist heeft vastgesteld, het recht juist heeft toegepast en of hij op de juiste wijze heeft rechtgesproken. Is dat niet het geval, dan wordt het vonnis van de rechter in eerste aanleg door het gerechtshof vernietigd.
• Herkansingsfunctie. Het kan zijn dat u in eerste aanleg verkeerde rechtsgrond heeft aangevoerd, uw stelling onvoldoende heeft aangescherpt of te weinig bewijs voor uw stelling heeft geleverd. Bij het gerechtshof geldt het principe van volledige herkansing. Niet alleen kunnen alle feiten opnieuw aan het gerechtshof ter beoordeling worden voorgelegd, maar krijgt u als partij in hoger beroep ook de mogelijkheid om de fouten die u in de eerste aanleg heeft gemaakt, te herstellen. Ook bestaat er in hoger beroep de mogelijkheid om uw eis eventueel te vermeerderen.

Kiest u voor de vervolgprocedure bij het gerechtshof, dan dient u binnen een bepaalde termijn hoger beroep in te stellen. De duur van de termijn hangt af van het soort zaak. Betreft het vonnis een uitspraak van een civiele rechter, dan heeft u drie maanden vanaf de datum van het vonnis om hoger beroep in te stellen. Had u in eerste aanleg te maken met een kort geding? Dan geldt een termijn van slechts vier weken voor het instellen van hoger beroep bij het gerechtshof. Heeft de strafrechter zich over uw zaak gebogen en uitgelaten? In dat geval heeft u slechts twee weken na de uitspraak voor het instellen van hoger beroep bij het gerechtshof.

Omdat de appeltermijnen rechtszekerheid dienen, moet ook strikt aan deze termijnen worden gehouden. Appeltermijn betreft dan ook een fatale termijn. Wordt binnen dit termijn geen procesinleiding ingediend? Dan bent u als procesdeelnemer te laat en derhalve niet ontvankelijk. Slechts bij hoge uitzondering is het instellen van hoger beroep na het verstrijken van de fatale appeltermijn toch toegestaan. Dit kan bijvoorbeeld aan de orde zijn als de oorzaak van het te laat ingestelde hoger beroep een fout van de rechter zelf is omdat hij de beschikking te laat naar de partijen heeft verzonden.

De procedure

In het kader van het hoger beroep geldt als uitgangspunt dat bepalingen met betrekking tot de eerste aanleg ook van toepassing zijn op de procedure in hoger beroep. Het hoger beroep wordt dan ook aangevangen met een dagvaarding in dezelfde vorm en met dezelfde vereisten als die in eerste aanleg. Daarin hoeven echter nog niet de gronden voor het hoger beroep te worden vermeld. Deze inhoudelijke grieven dienen pas aan bod te komen in de memorie van grieven waarmee de dagvaarding wordt opgevolgd.

Grieven zijn alle gronden die de appellant moet aanvoeren om te betogen dat het bestreden vonnis van de rechter in eerste aanleg behoort te worden vernietigd. Die onderdelen van het vonnis waartegen geen grieven zijn aangevoerd, blijven in stand en komen in hoger beroep niet meer ter discussie. Op deze wijze wordt het debat in hoger beroep beperkt en daarmee de rechtsstrijd begrensd. Omdat het vonnis in stand wordt gelaten voor zover het niet wordt aangevallen, is het derhalve belangrijk om gemotiveerd bezwaar te voeren tegen in eerste aanleg gewezen vonnis. Belangrijk is om in dit kader te weten dat een zogenaamde algemene veeggrief, waarmee wordt beoogd om het geschil in volle omvang aan de appelrechter voor te leggen, niet kan en zal slagen. Met andere woorden: een grief in hoger beroep moet een concreet bezwaar inhouden zodat het voor de wederpartij in het kader van verweer kenbaar is wat de bezwaren precies zijn.

Na memorie van grieven volgt de memorie van antwoord. De verweerder in hoger beroep kan van zijn kant ook grieven naar voren brengen tegen de bestreden uitspraak en reageren op de memorie van grieven van de appellant. Met de memorie van grieven en de memorie van antwoord eindigt doorgaans de uitwisseling van de schriftelijke standpunten in hoger beroep. Nadat de schriftelijke stukken zijn uitgewisseld is het in beginsel niet meer toegestaan nieuwe grieven naar voren te brengen, ook niet teneinde alsnog de eis te vermeerderen. In het arrest Maclaine Pont/De Haan is dan ook bepaald dat de rechter niet meer mag letten op de grieven die pas na de memorie van grieven dan wel memorie van antwoord worden aangevoerd. Hetzelfde geldt voor vermeerdering van de eis. Echter, bij wijze van uitzondering is een grief in het latere stadium alsnog toelaatbaar is als de wederpartij daartoe zijn toestemming verleend, de grief voortvloeit uit de aard van het geschil of er is sprake van een nieuw opgekomen omstandigheid nadat de schriftelijke stukken waren ingediend.

Als uitgangspunt wordt de schriftelijke ronde in de eerste aanleg altijd opgevolgd door een mondelinge behandeling. In het hoger beroep bestaat op dit uitgangspunt een uitzondering: de mondelinge behandeling bij het gerechtshof is facultatief en derhalve niet gebruikelijk. De meeste zaken worden dan ook doorgaans schriftelijk afgedaan door het gerechtshof. Echter, beide partijen kunnen het gerechtshof wel verzoeken om hun zaak nog eens mondeling te mogen bepleiten. Als een partij een mondelinge toelichting wil geven in hoger beroep, zal het gerechtshof dat behoudens bijzondere omstandigheden moeten toestaan. In zoverre blijft de rechtspraak over recht op pleidooi in stand.

De laatste stap in de procedure bij het gerechtshof is de uitspraak, ook wel arrest genoemd. In dit arrest zal het gerechtshof aangeven of de eerdere uitspraak van de rechtbank een juiste beslissing was. In de praktijk kan het zijn dat het wel eens zes maanden of langer kan duren voordat partijen het eindoordeel van het gerechtshof tegemoet kunnen zien. Wanneer de grieven van de appellant gegrond worden bevonden, dan zal het gerechtshof het bestreden vonnis vernietigen en zelf de zaak afdoen. Acht het gerechtshof de grieven van de appellant ongegrond, dan zal het gerechtshof het bestreden vonnis logischerwijs in stand laten.

Bent u het niet eens met de uitspraak van de bestuursrechter? Dan kunt u eveneens in hoger beroep. Echter, wanneer u te maken heeft met het bestuursrecht, is het belangrijk om in het oog te houden dat u in dat geval allereerst te maken krijgt met andere termijnen. Er geldt doorgaans een termijn van zes weken vanaf het moment dat de uitspraak van de beroepsrechter bekend is gemaakt, waarbinnen u hoger beroep kunt instellen. Daarnaast krijgt u te maken met andere instanties waarbij u terecht kunt in het kader van hoger beroep. Bij welk gerechtshof u moet zijn, hangt af van het soort zaak:

• Sociale zekerheids- en ambtenarenrecht. De zaken over sociale zekerheid en ambtenarenrecht worden in hoger beroep behandeld door de Centrale Raad van Beroep (CRvB).
• Economisch bestuursrecht en tuchtrechtspraak. Zaken in het kader van onder andere de Mededingingswet, Postwet, Warenwet en Telecommunicatiewet worden door het College van Beroep voor het Bedrijfsleven (CBb) behandeld.
• Vreemdelingenrecht en overige zaken. De overige zaken inclusief vreemdelingenzaken worden in hoger beroep door Afdeling bestuursrechtspraak van de Raad van State (ABRvS) behandeld.

Na het hoger beroep

Doorgaans leggen de partijen zich neer bij de uitspraak van het gerechtshof en is de zaak daarmee in hoger beroep ook afgedaan. Bent u het echter niet eens met het arrest van het gerechtshof? Dan bestaat er nog een mogelijkheid om tot drie maanden na het arrest van het gerechtshof cassatie in te stellen bij de Hoge Raad. Deze mogelijkheid geldt niet voor uitspraken van de ABRvS, de CRvB en het CBb. Immers de uitspraken van deze instanties bevatten eindoordelen. Het is dan ook niet mogelijk om op te komen tegen deze uitspraken.

Wanneer de mogelijkheid van cassatie bestaat, moet in het oog worden gehouden dat daarbij geen plaats is voor feitelijke beoordeling van het geschil. De gronden voor cassatie zijn bovendien zeer beperkt. Immers, cassatie kan slechts worden ingesteld voor zover de lagere rechters het recht niet op de juiste manier hebben toegepast. Het is daarom een procedure dat jaren in beslag kan nemen en hoge kosten met zich mee kan brengen. Het is dan ook belangrijk om alles uit hoger beroep te halen wat erin zit.
