Het begrip media omvat onder andere kranten, televisie, radio en internet. Binnen het mediarecht wordt de vrijheid van meningsuiting afgewogen tegen het recht op bescherming van iemands eer en goede naam. Het recht op vrijheid van meningsuiting kent bepaalde grenzen. Kritische uitlatingen zijn niet strafbaar.

Hier zijn echter wel grenzen aan verbonden; meningen mogen niet onrechtmatig zijn of schadend voor de andere partij. Het streven is om een goede balans te vinden tussen de vrijheid van meningsuiting en beperkingen daarop. Hierbij spelen de omstandigheden van het geval een grote rol.

Onderwerpen die vaak aan de orde komen binnen het mediarecht zijn onrechtmatige publicatie en onrechtmatige uitlatingen. Van onrechtmatige publicatie is sprake wanneer er over een persoon of bedrijf feitelijke onjuistheden worden geplaats. Vaak gaat het hierbij om valse beschuldigingen van strafbare feiten. Van onrechtmatige uitlatingen is sprake wanneer er in het openbaar onwaarheden of valse beschuldigingen over een persoon of bedrijf verteld worden. Hierdoor kan de reputatie van de betreffende persoon of het betreffende bedrijf geschaad of zelfs geruïneerd worden. Ook kan een valse publicatie gevolgen hebben voor de persoonlijke levenssfeer van de betreffende persoon. De vraag of een publicatie onrechtmatig is, moet per geval beantwoord worden. Hierbij maakt de rechter de bovengenoemde belangenafweging tussen de vrijheid van meningsuiting en het recht op bescherming van de eer en goede naam.

Wanneer een publicatie of uitlating onrechtmatig is, kan de betreffende persoon in een kort geding rectificatie of verwijdering van de publicatie vorderen. Hiervoor moet een advocaat ingeschakeld worden. Bij het eisen van rectificatie komt bovendien het nodige kijken. Er moet niet alleen nagedacht worden over de tekst zelf, maar ook over de plaats waar de rectificatie plaats moet vinden, de periode dat de rectificatie geplaatst moet worden en zelfs over lettertype en -grootte.

Verder is het ook mogelijk om een schadevergoeding te eisen wanneer er een onrechtmatige publicatie geplaats is of er onrechtmatige uitlatingen gedaan zijn. Het vorderen van rectificatie en/of verwijdering van een onrechtmatige publicatie of uitlating en het eisen van een schadevergoeding wegens reputatieschade zijn civielrechtelijke acties. Het kan echter ook mogelijk zijn dat een onrechtmatige publicatie of uitlating een strafbaar feit oplevert, waarvan aangifte gedaan kan worden. Hierbij gaat het vooral om smaad, smaadschrift of laster. Bij smaad wordt opzettelijk iemands eer of goede naam aangetast door een bepaald feit ten laste te leggen, met het doel dit openbaar te maken. Journalisten

Binnen het mediarecht spelen journalisten een grote rol. Zij zijn natuurlijk vaak de personen die stukken schrijven en publiceren. Journalisten hebben veel vrijheden als het gaat om het maken van publicaties. Dit wordt ook wel het recht van persvrijheid genoemd, dat voortvloeit uit de Grondwet. Hierbij geldt echter ook de regel dat de informatie correct moet zijn en niet iemands goede naam aan mag tasten. Dit staat beschreven in de Code voor de journalistiek, waar journalisten zich aan moeten houden. In deze Code staan regels die betrekking hebben op het gedrag van journalisten ten opzichte van hun geschreven werk. Journalisten hebben het recht om een geschreven stuk te publiceren waarvan zij denken dat het de waarheid is of als zij dit van een betrouwbare bron vernomen hebben. Journalisten mogen schrijven over bepaalde personen, maar moeten hierbij wel rekening houden met de privacy van deze personen. De informatie over de betreffende personen moet dan ook zo beperkt mogelijk blijven.
