Tegenwoordig doen we steeds meer aankopen via internet. Een van de populaire websites daarvoor is Marktplaats. Meestal gaat het goed en krijgt u daadwerkelijk wat u heeft besteld. Helaas gaat het soms ook mis: u heeft voor bepaalde zaken zoals een telefoon of een laptop veel geld betaald, maar de verkoper heeft de zaken nooit geleverd en lijkt ook niet van plan om dat nog te doen. Immers, als u wilt informeren waar u spullen blijven, is de verkoper nergens te bekennen. In dat geval bent u mogelijk slachtoffer van strafbare internetoplichting.

Om een strafbare oplichting in juridische zin aan te kunnen nemen, dient namelijk sprake te zijn van onwaarheden of leugens die de verkoper gebruikt om iets te verkopen en zo het geld te ontvangen waarop hij normaal geen recht zou hebben. Enkel het niet leveren van zaken waarvoor wel is betaald, is onvoldoende om oplichting aan te nemen en kan niet direct tot een veroordeling van de verkoper leiden.

Het kan onder omstandigheden dus zo zijn dat u zich weliswaar voelt opgelicht, maar dat van oplichting in strafrechtelijke zin geen sprake is. Echter, dat betekent niet dat u met lege handen achterblijft. Het is namelijk mogelijk dat voor u de civielrechtelijke weg open staat om de ‘oplichter’ aan te pakken. Niet alleen particulieren maar ook grote organisaties en bedrijven worden tegenwoordig steeds vaker door internetoplichting getroffen. Zij hebben met name te maken met de volgende vormen van cybercrime: phishing en ransomware.
