De kennismigrantenregeling binnen het Nederlandse vreemdelingenbeleid maakt het voor ondernemingen mogelijk om relatief snel en eenvoudig kennismigranten aan te trekken. Bent u een kennismigrant en wilt u een bijdrage leveren aan de Nederlandse kenniseconomie? Dan heeft u allereerst een verblijfsvergunning nodig. Alvorens een verblijfsvergunning wordt verleend, dient u:

Een arbeidsoverkomst met een werkgever of onderzoeksinstelling in Nederland te hebben, die door de IND als een erkende referent is aangemerkt en opgenomen in het openbaar register erkende referenten;
Voldoende inkomen te gaan verdienen;
Een marktconform loon met uw werkgever te zijn overeengekomen.

Is er een verblijfsvergunning aan u verleend? Dan is de geldigheidsduur van uw verblijfsvergunning gelijk aan de duur van uw arbeidsovereenkomst of aanstelling. Met een maximum van 5 jaar. De vergunning kan onbeperkt worden verlengd.

Tijdens de geldigheidsduur van uw verblijfsvergunning kunt u als kennismigrant van werkgever wisselen en in dienst treden bij een andere onderneming die door de IND erkend is als referent. Zowel door de oude als de nieuwe werkgever moet uw banenwissel binnen vier weken bij de IND worden gemeld.

Raakt u als kennismigrant werkloos? Dan heeft u, vanaf de dag nadat uw dienstverband is geëindigd, recht op een zoekperiode van drie maanden. Als het u niet lukt om binnen de zoekperiode als kennismigrant in dienst te treden bij een andere werkgever (referent), dan zal de IND uw vergunning intrekken.

Vanaf juni 2011 kunt u als ken arbeidscontract te hebben van twaalf maanden of langer, minimaal een 3-jarige bacheloropleiding hebben afgerond in het hoger onderwijs (hbo) en per maand minimaal de loondrempel van de Blauwe Kaart behalen.
