Bij incasso problemen denk je eerder aan een incassobureau of gerechtsdeurwaarder dan aan een incasso advocaat. Alle drie de partijen zijn namelijk in staat om openstaande vorderingen te incasseren. Toch zijn er enkele essentiële werkzaamheden in het incassoproces die vooral een incasso advocaat kan uitvoeren: een incasso advocaat heeft meer middelen om vorderingen succesvol te innen dan een incassobureau. Voor vorderingen boven €25.000,- kan een incasso advocaat bovendien meer rechtsmaatregelen inzetten dan een deurwaarder of incassobureau. In tegenstelling tot het zomaar een incassobureau beginnen zonder de juiste kwalificaties, biedt een advocatenkantoor dienstverlening die voldoet aan de strenge eisen van de advocatuur.

Het volgende overzicht geeft de essentiële werkzaamheden weer die vooral een incasso advocaat kan uitvoeren.

Het komt vaak voor dat er tijdens een incassoproces alsnog moet worden gewisseld van een incassobureau of deurwaarder naar een incasso advocaat. In zo’n situatie is het makkelijker en overzichtelijker om meteen bij hetzelfde kantoor te zijn, waar men u al kent en er al een dossier voor u is opgebouwd. U heeft een incasso advocaat nodig wanneer een incassobureau faalt, bij complexe juridische kwesties, of voor vorderingen boven €25.000 (zoals voor niet-huurvorderingen). Voor het incasseren van vorderingen boven €25.000 (uitgezonderd huur) is een advocaat wettelijk verplicht om de procedure te starten. Zaken goed geregeld hebben en heldere afspraken maken vormen de basis voor een succesvolle incasso en een gezonde bedrijfsvoering.

1. Minnelijke fase. Is uw vordering incasseerbaar, dan kan allereerst door de incasso advocaten van Law & More een minnelijke procedure worden gestart. In deze fase proberen wij middels brieven en/of telefoontjes de debiteur alsnog tot betaling, eventueel verhoogd met wettelijke rente en buitengerechtelijke incassokosten, te bewegen. Tijdens het voortraject worden aanmaningen en een correcte brief verstuurd, wat essentieel is voor een succesvolle incassozaak. Onze cliënten krijgen online inzicht in hun incassozaak via een portal, waar zij de voortgang, betalingen en documenten kunnen volgen. Deze werkwijze helpt om wanbetaling te voorkomen en debiteuren snel te laten betalen, zodat uw vordering zo spoedig mogelijk wordt geïncasseerd. Law & More hanteert een gestructureerde aanpak met een hoog slagingspercentage bij zakelijke incasso’s. Voor minnelijke incasso’s is een no pay afspraak mogelijk: u betaalt alleen als er daadwerkelijk is geïncasseerd. Deze fase is cruciaal omdat het vaak de snelste en meest kosteneffectieve manier is om tot een oplossing te komen zonder tussenkomst van de rechter. Buitengerechtelijke incasso is vaak het snelst en meest kostenefficiënte traject. Hierbij wordt ook rekening gehouden met de regels van de wet incassokosten, zodat de incassokosten die in rekening worden gebracht wettelijk correct zijn. Daarnaast kunnen in deze fase ook betalingsherinneringen worden verstuurd om de debiteur nogmaals aan zijn betalingsverplichting te herinneren. De veertiendagenbrief is een verplichte aanmaning bij de incasso van particuliere vorderingen.

2. Onderhandelingen. Heeft u goede verhoudingen met uw wederpartij en wilt u deze goede verhouding ook graag behouden? Dan proberen wij in deze fase door middel van onderhandelingen overeenstemming tussen partijen te bereiken en bijvoorbeeld een betalingsregeling te treffen. Dit voorkomt onnodige escalatie en kan leiden tot een oplossing die voor beide partijen acceptabel is. Heldere afspraken zijn hierbij van essentieel belang om misverstanden en toekomstige conflicten te voorkomen. Onze advocaten adviseren u ook hoe u uw creditmanagement kunt verbeteren om toekomstige wanbetalingen te voorkomen.

3. Gerechtelijke fase. Het doorlopen van de minnelijke procedure is niet verplicht. Werkt uw debiteur niet mee, dan kan door onze incasso advocaten een dagvaarding worden opgemaakt en verstuurd naar uw debiteur. Met de dagvaarding wordt de debiteur opgeroepen om op een bepaalde datum in de rechtbank te verschijnen. In een gerechtelijke fase vorderen we voor de rechter betaling van de openstaande bedragen en incassokosten. In deze fase worden gerechtelijke procedures gevoerd, waarbij de tussenkomst van de rechter noodzakelijk is als minnelijke incasso’s niet tot resultaat leiden. Voor gerechtelijke procedures geldt doorgaans een uurtarief, zodat u vooraf inzicht heeft in de kosten. Dit traject vereist juridische expertise en kennis van de juiste procedures, waarbij onze advocaten u met hun ervaring en expertise kunnen bijstaan. De gerechtelijke incasso biedt meer mogelijkheden, zoals het aanvragen van conservatoir beslag of het starten van een faillissementsaanvraag indien nodig. In sommige gevallen kan ook een kort geding worden gestart om snel een voorlopige voorziening te verkrijgen.

4. Het vonnis. Nadat uw debiteur de dagvaarding heeft ontvangen, krijgt hij vervolgens de mogelijkheid om schriftelijk op de dagvaarding te reageren. Blijft de reactie van de debiteur uit en verschijnt hij ook niet op de zitting, dan zal de rechter een verstekvonnis wijzen waarbij hij uw vordering toewijst. Dat betekent dat uw debiteur de factuur, de wettelijke rente, de incassokosten en de procedurekosten dient te betalen. Nadat een veroordelend vonnis door de rechter wordt uitgesproken, zal de deurwaarder dit vonnis aan de debiteur betekenen. Dit vonnis biedt een sterke basis voor verdere executiemaatregelen en verhoogt het slagingspercentage van het incassotraject aanzienlijk. De veertiendagenbrief is de verplichte aanmaning die verzonden moet worden conform de WIK.

5. Het beslag. Voordat de gerechtelijke procedure gestart wordt, is het eventueel mogelijk om beslag te leggen op eigendommen van de debiteur. Dit wordt conservatoir beslag genoemd. Conservatoir beslag is bedoeld om ervoor te zorgen dat de debiteur geen bezittingen weg kan sluizen voordat de rechter uitspraak doet, zodat u uw kosten ook daadwerkelijk op de debiteur kunt verhalen. Als de rechter uw vordering toewijst, wordt het conservatoire beslag omgezet in een executoriaal beslag. Dat betekent dat de bezittingen waarop het beslag is gelegd door de deurwaarder in het openbaar verkocht mogen worden als de debiteur nog steeds niet betaalt. De rol van deurwaarders is hierbij essentieel, omdat zij bevoegd zijn om het vonnis uit te voeren en de verkoop te organiseren. Voor cliënten is het van groot belang dat hun gelden correct worden beheerd en veilig worden gesteld volgens de geldende regels. Een vordering wordt pas als geïncasseerd beschouwd wanneer het bedrag daadwerkelijk is betaald en op uw rekening staat. Een goed voortraject vergroot de kans op een succesvolle incassozaak aanzienlijk. Er is een duidelijk verschil tussen incasso’s die in eerste instantie minnelijke worden opgelost en incasso’s waarvoor gerechtelijke procedures noodzakelijk zijn; een juiste aanpak in het voortraject bepaalt vaak het verdere verloop en succes van de zaak.

Het incassorecht in Nederland betreft het (buitengerechtelijk) innen van geldvorderingen. In de praktijk wordt dit ook wel Nederlandse incasso genoemd. Nederlandse incasso kent specifieke eisen en regels, waarbij gespecialiseerde advocaten, aangesloten bij de Nederlandse Orde van Advocaten, zorgen voor een kwalitatieve en wettelijk verantwoorde dienstverlening. Wanneer u openstaande facturen uit handen geeft aan incasso advocaten, dan verleent u volgens het incassorecht een soort machtiging aan de incasso advocaten om uw openstaande vorderingen te incasseren. Dit geldt zowel voor zakelijke incasso’s als voor particuliere incassozaken. Dat is bijvoorbeeld voordelig voor particulieren of ondernemingen die zelf te weinig tijd hebben of die zich vooral willen richten op hun core business. Bovendien zijn aan (het innen van) de openstaande facturen allerlei regels verbonden, bijvoorbeeld omtrent opeisbaarheid en verjaring en komen er meerdere partijen bij kijken. Dat maakt het incassorecht interessant, maar wel complex. Incasso advocaten bieden juridische expertise en een heldere communicatie voor het incasseren van vorderingen. Zij begeleiden het volledige voortraject, sturen aanmaningen en brieven, bieden online inzicht in uw incasso’s en schakelen indien nodig deurwaarders in of starten gerechtelijke procedures. De eerste stap die genomen moet worden is de debiteur op de hoogte brengen van het feit dat hij niet aan zijn betalingsverplichting voldoet. U moet hem namelijk de kans geven om binnen een redelijke termijn alsnog zonder verdere kosten te betalen. U stuurt hiervoor een schriftelijke aanmaning naar de debiteur, dit wordt een ingebrekestelling genoemd. Een termijn van veertien dagen wordt normaal gesproken als een redelijke termijn gezien waarbinnen de debiteur verzocht wordt de vordering alsnog te betalen. Uiteraard kunnen de incasso advocaten van Law & More een ingebrekestelling voor u opstellen. Wanneer er geen ingebrekestelling verstuurd is, wijst de rechter een gevorderde schadevergoeding af. Er zijn echter situaties waarin het versturen van een ingebrekestelling niet nodig is, bijvoorbeeld nakoming van de overeenkomst blijvend onmogelijk is.
